Warranty

This warranty is provided by ‘The Company’ in regard to groundworks and or other associated activities undertaken on site (excluding reactive works).

‘The Company’ warrants that the Works will be free from defects in materials and workmanship for a period of 12 months from the date of practical completion.

If any defects in the Works become apparent during the warranty period, ‘The Company’ will, at its own expense, repair or replace the defective materials or workmanship.

This warranty does not cover defects caused by:

• Normal wear and tear;
• Negligence or misuse;
• Improper maintenance;
• Accident or damage;

Modification or alteration of the Works without ‘The Companies’ prior written consent;

Use of the Works for a purpose other than that for which they were designed;

Acts of God, fire, flood, earthquake or other natural disasters.

This warranty is subject to the following conditions:

The Owner must give the ‘The Company’ written notice of any defects within 30 days of their discovery;

‘The Company’ will be given reasonable access to the Works to inspect and repair any defects;

The Owner must not carry out any repairs or alterations to the Works ‘The Companies’ prior written consent;

The Owner must maintain the Works in accordance with the manufacturer’s recommendations and any applicable laws and regulations.

This warranty is the sole and exclusive remedy of the Owner in respect of any defects in the Works and ‘The Contractors’ liability under this warranty is limited to the cost of repairing or replacing the defective materials or workmanship.

Effective date of warranty is that of practical completion of on site works.
